Cargo Claim Process

 

1.If loss/damage
is found

(1) Duty to Mitigate damage

Mitigate the extent of damage, taking all reasonable measures to minimize and prevent further loss or damage.

(2) Take remarks on delivery records

When goods are delivered from ocean / air carriers, port authorities, customs & inland carriers, take remarks on delivery records at each stage of delivery.

Entry example,

  • 2 packages short delivered, broken, wet
  • 1 package No.2 torn and 3 pieces missing
  • 5 coils heavily dented and covers rusty

 

Things to Avoid

  • Do not sign a clean delivery receipt if the cargo has arrived in damaged or short shipments.
  • Do not dispose of damaged cargo and/or packing material prior to survey or our consent.
  • If there is a risk that the damage will increase, please take reasonable measures to minimize and prevent further loss or damage.

 

In case of containerized cargo

When receiving cargo by container, please take the following points into consideration.

  • Before opening the container door, check whether there are any abnormalities in the container seal and whether the letters and numbers on the seal are the same as on the B/L.
  • While removing the contents of the container, check the number of items and whether there are any exterior abnormalities.
  • Please be aware that if a shortage or damage is discovered a significant amount of time after devanning, and it is unclear when and where it occurred, it may not be covered by insurance.

 

2.Report the loss/
damage to the Insurers
and carriers

1. Report the loss/damage immediately to the Insurers

  • When the cargo was damaged in export/trilateral transport, please notify claim agents designated on policy.

2. Please send Invoice, Packing List, B/L, photographs by Email.

3. Immediately send claim notice to the carrier and any other responsible parties.
If the case of air transport, please make sure to send claim notice within 14 days.

 

Non-Delivery

When you find loss, please request the investigation for undelivered cargo against the carrier. If it cannot be found through investigation, a written confirmation of non-delivery (Non-Delivery Certificate) must be obtained from the responsible party in the end.

Pilferage

After the receiving the cargo, please inspect the contents of the cargo immediately.

 

3.Checking
the damage situation

(1) A survey will be conducted depending on the damage situation.

(2) In some cases where the claim amount is minimal, a survey may not be necessary.

 

About inspector (surveyor)

A specialist who investigates the details of an accident, its cause, damage, etc., from a third-party perspective. If the amount of damage is expected to exceed a certain amount, an inspector (surveyor) will be sent to conduct a survey. Moreover, if there are any points of uncertainty regarding the cause of the accident, time of occurrence, or the like, an inspector may be sent to conduct an on-site investigation regardless of the estimated amount of damage.

4.Determination of
the amount of insurance
to be paid
  • The insurance company will determine the amount of insurance to be paid based on the results of the inspector's on-site investigation (survey report).
  • Where appropriate, you may be asked to consider repairing/retouching the damaged items as well as whether they can be resold.
5.Send claim
documents
Please send all required documents to us.
6.Receive payment

The insurance company will pay the insurance money to your designated account and send the payment notice.

 

7.Subrogation claim
against carriers or other
third parties

After paying the insurance money, the insurance company will claim damages from the person responsible for the accident on your behalf.

 

Subrogation of claims
As one of the conditions of insurance, the customer is obligated to maintain their right to claim damages from the person responsible for the accident (such as a carrier). Please note that the following procedures are required in order to verify the insured accident and claim damages from the party responsible for the accident. Moreover, after paying the insurance money, we may claim damages from the party responsible for the accident on your behalf.

    Please take photos of the packaging and damaged items, except when the cargo is undelivered.
  5. Delivery Receipt upon cargo arrival
    Containerized Cargo: Devanning Report
    Bulk Cargo: Cargo Boat Note, 入庫報告書, Landing Report
    Air Cargo: Delivery Order, 内容点検実施報告書
  6. Notice of Claim to carrier <Form 3>
    This is used to protect your right to claim against the shipping company/airline by notifying them in writing that there is damage to the cargo. If an NVOCC or customs broker issues the notice on your behalf, please provide a copy.
  7. Reply Letter from carrier (if any)
    This is a response from the shipping company/airline to the Notice of Claim.
  8. Repair quotation / Cost Vouchers, etc. (for repair process)
    If the damaged cargo is to be repaired or retouched, please submit a detailed cost estimate (quotation or receipt).
  9. 損害状況報告書(事故現認書)<Form 2>
    If no survey is conducted, please provide specific details about the damage, such as the condition, extent, quantity, and feasibility of repair.
  10. Survey report
    If deemed necessary by the insurance company, an on-site survey (inspection) will be conducted. Please keep the damaged cargo in its condition at the time of the incident as much as possible. Additionally, if there is a risk of further damage, please take photos of the damaged cargo and proceed with sorting or retouching as necessary.
  11. Other documents
    If additional documents are required, the insurance company's marine claims representative will contact you.
